this error is coming up with a new employee, tried to fix what am i missing???

Thanks for your post. When you received the ATO error code: CNM.ATO.PAYEVNTEMP.000361 and tried to fix the error, were you able to check as well the Income type entered for the new employee?
If you are using AccountRight, to check it go to Card File > Cards List > Employee tab > Click the zoom arrow beside the employee name > Payroll Details tab > Taxes > Income Type.
If you are using MYOB Business/Essentials, go to Payroll > Employees > Click the name of the employee > Payroll details tab > Taxes > Income Type.
Most likely the cause the error is when you have an employee of Income Type Voluntary Agreement, Labour Hire or Other Specified Payments - and you are paying them an overtime. These income types cannot be paid an overtime - as they are contractors not employees.

Yes it was the income type, i had originally put him as labour hire but changed is work status. it was a simple but hard error to pick up thanks
