Termination of an Employee

IS THIS INFORMATION BELOW  FROM 2017 STILL CORRECT ?  OUR BUSINESS HAS 5 EMPLOYEES AND ONE PERSON HAS BEEN TERMINATED AND WILL BE PAID IN LIEU OF NOTICE -  THEREFORE IS THIS PAY JUST PROCESSED NORMALLY AND NOT AS AN ETP?  JUST LOOKING FOR SOME UP TO DATE ADVICE PLEASE IF POSSIBLE
thank you

Businesses with less than 15 employees do not need to pay ETP. For all sorts of practical reasons I would not consider the Payment in Lieu of Notice as an ETP. This would mean that it is taxed at the same rate and would attract Super.

Re: Termination of an Employee

Hi @Linda6602

Thank you for your post.

My recommendation is to have a look at the current rules and obligations set out by the ATO with respect to the handling of ETP's and terminations, which will better guide you to what is required and expected in this matter.

Please let us know if you have any further questions.

Kind regards,
Jesh
