staple super fund not chosen by employee

I recently onboarded 2 new employees and have paid their super based on their details entered and super choice, no problem (one chose our default fund and we followed process to add him a new account).

Then today I received a notice in the mail from ATO with our "stapled super request outcomes" and it turns out that the employee that chose our default fund already has a super account with Virgin as his stapled fund.

What am I supposed to do with this information given that the employee obviously didn't see the staple super fund presented to him in the onboarding process or chose to ignore and nominate our default fund instead?

As an employer, we can only go off what the employee submits to our payroll system at the time as we don't get the ATO notification til after we have paid the super (especially now that sgc is paid on a weekly basis with payroll).

    Hi natk,

     

    That’s one of those awkward little stapled super moments. Since the ATO outcome has now shown that the employee already has a stapled fund, it’d be best to speak with the employee directly and confirm which fund they want their contributions paid to going forward. That way you can make sure the super details in payroll line up with what they intend to use.

    Hi Doreen

    That's all well and good however there probably needs to be another solution that myob can look into or make it a lot clearer to the employee when onboarding to prevent this as it is a waste of time and possibly costs of unnecessary fees incurred by the employee by opening an unnecessary additional Super account with our default fund.

    Its not really our concern as an employer as we are simply following the employee's instructions on their Super Choice Form however I thought one of the reasons for incorporating the staple super/flare situation was to prevent multiple super accounts being opened for employees with every new job..

    As this only started from 1/7/26, I'm going to assume this will happen with other MYOB customers unless there is a fix in place.
